These Terms of Service (“Terms”) govern your access to and use ofvizmedia.agency and the services provided byvizmedia (“vizmedia,” “we,” “us,” or “our”). By using the Site or engaging our services, you agree to these Terms.
vizmedia provides web design, web development, and related lead-capture and marketing services for businesses. The specific scope, deliverables, timeline, and price for any engagement are agreed in writing before work begins.
Project pricing is provided as a fixed quote agreed up front. Payment terms, including any deposit and milestones, are set out in your project agreement. Payments may be processed through third-party payment providers; by paying, you also agree to their terms.
Upon full payment, ownership of the final deliverables produced specifically for you transfers to you, except for any third-party components, open-source software, or tools that remain subject to their own licenses. vizmedia retains the right to display work produced as part of its portfolio unless otherwise agreed in writing.
By contacting us or opting in, you agree to receive communications related to your inquiry or project. SMS/text-message communications are governed by ourPrivacy Policy; you may opt out of texts at any time by replying STOP.
The Site and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
To the maximum extent permitted by law, vizmedia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or services. Our total liability for any claim will not exceed the amount you paid to us for the services giving rise to the claim.
Either party may terminate an engagement as provided in the applicable project agreement. We may suspend or terminate access to the Site at any time for conduct that violates these Terms or applicable law.
These Terms are governed by the laws of the United States and the state in which vizmedia operates, without regard to conflict-of-law principles.
We may update these Terms from time to time. Changes are effective when posted here, with the “Last updated” date revised accordingly.
